The Privacy Statement governs your ERIC account and any information
you provide on this site and to SAFE Risk Management Systems, LLC
in the course of providing services to you.
The Privacy Statement of SAFE Risk Management Systems (hereafter
referred to as "the Company") demonstrate our deep commitment
to full disclosure regarding privacy issues. Since we gather certain
types of information about our subscribers, we want subscribers
to fully understand the terms and conditions surrounding the capture
and use of that information. This privacy statement discloses what
information we gather and how we use it. The Privacy Statement informs
you of our practices regarding personally identifiable information
that may be collected in the course of providing any of our services
to you.
Collection and Use of Personally Identifiable Information
In order that we may provide service to you and operate efficiently,
we collect the following types of information about you that may
constitute personally identifiable information: your name, work
address, and telephone numbers. Depending on the services we provide
to you, our records also may include information on billing and
payment, and the service options you have chosen. We also keep records
of research concerning subscriber satisfaction with the service,
which are obtained from subscriber interviews and questionnaires.
We also maintain subscriber correspondence (via e-mail or otherwise)
and, if you are a SAFE ERIC subscriber, records of violations and
alleged violations of your Subscription Agreement and other rules
governing use of the ERIC or other SAFE Services.
The personally identifiable information described in the preceding
paragraph is used for purposes such as the following: to make sure
you are being billed properly for the services you receive; to send
you pertinent information about SAFE services; to improve the quality
of SAFE and ERIC services; to answer questions from subscribers
such as troubleshooting; to ensure compliance with relevant law
and contractual provisions; and for tax and accounting purposes.
In addition, to render and improve SAFE services, the ERIC system
is designed to collect automatically by SAFE information on use
of the service, including information on the choices made among
the range of services offered, the timing of visits to sites, and
the length of visits to sites. SAFE, as described above, in providing
the ERIC service to you, also has access to personally identifiable
information about you or your ERIC account, including the name,
addresses, and other associated with the account.
The Company gathers subscriber information using some or all of
the following processes:
- Cookies: The Company minimizes the use of cookies to
only those necessary to properly route subscribers, and customize
the subscriber's experience. The Company provides links to advertiser
and partner websites. These sites may choose to use cookies to
better promote their products and services.
- Usage Tracking: The Company tracks information related
to the electronic mailings and web pages viewed by subscribers,
as well as the hyperlinks clicked by subscribers, while viewing
our emails or visiting our websites.
- Log Files: Log files are used to track and monitor subscriber
usage.
Subscriber Feedback/Inquiries: Subscribers have the ability to
contact the Company to provide us with their feedback. The Company
uses this information to respond to the subscriber and analyze
customer service issues.
- Benchmarking & Market Data: Information gathered
through aggregated tracking information derived mainly by benchmarking
and tallying scores and results throughout ERIC. This information
allows us to present a complete benchmarking service to all subscribers
to better understand their own demographics. Under no circumstances
does SAFE ever divulge any specific information about any specific
subscriber data to a third party.
Disclosure of Personally Identifiable Information
Personally identifiable information that we maintain related to
our subscribers will be disclosed without the prior written or electronic
consent of subscribers only if: (1) it is necessary to render, or
conduct a legitimate business related to, the services that are
provided to you; (2) such disclosure is required by law or legal
process as described below. The types of persons to whom information
about you may be disclosed in the course of providing cable service
to you include the employees of SAFE and its related legal entities,
agents, repair and installation subcontractors, sales representatives,
accountants, billing and collection services and credit reporting
agencies, consumer and market research firms, and authorized representatives
of governmental bodies. Also upon reasonable request, personally
identifiable information is disclosed to persons or entities with
an equity interest in legal entities related to SAFE when they have
a legal right to inspect our books and records.
Information for billing purposes is generally provided on a monthly
basis. Information for other purposes is provided as it is needed.
All information provided to the Company about a subscriber, as
well as any additional information we may lawfully collect regarding
a subscriber, may be used to support our services and data sharing
with marketing companies, advertising agencies, compilers, and data
companies. The Company does not control the practices of our advertisers
or third party marketers, who may further disseminate personally
identifiable information, including demographic and lifestyle data.
Subscription status, unsubscribe request activity, and personally
identifiable information is made publicly available for the purpose
of checking subscription status and for investigating subscription
issues.
Company emails and websites contain links to external websites.
Subscribers will be taken to external websites if they click on
these links. The subscriber's information may be passed from the
Companys database to the external website, and/or external
database, for the convenience of the subscriber (e.g. subscriber
information may be used to pre-fill a form at a destination website).
The Company is not responsible for the privacy practices or content
of any external website owner. We encourage all subscribers to review
the privacy Statement of any website they visit.
Disclosure of Information to Government Entities
and Other Legal Process
Federal law requires us to disclose personally identifiable information
to a governmental entity or other third party pursuant to a court
order.
If you subscribe to the ERIC service, a private party may use a
subpoena under the Copyright Act to obtain information about you
to maintain a copyright infringement suit against the poster of
online material, without any notice to you.
ERIC Benchmarking Data and Information
Data generated or entered into ERIC, by our subscribers through
the normal course and use of ERIC will be provided back as market
data to subscribers, through blind, aggregated, and
benchmarked processes for the purposes of improving the subscriber
experience. Blind data means that all the identifying
characteristics of a subscribers data will be removed prior to use
in benchmarking results.
Time Period That We Retain Personally Identifiable
Information
We maintain personally identifiable information about our subscribers
for as long as it is necessary for our business purposes. This period
of time lasts as long as you are a subscriber and up to five additional
years so that we can comply with tax and accounting requirements.
Your Online Communications on the ERIC Service
Information and/or Data that is generated by our subscribers and
entered into the ERIC platform will be accessible for viewing and
manipulation by SAFE for the purposes of providing services as contracted.
Subscribers acknowledge and expressly agree that while ownership
of such information and/or data remains the exclusive right of our
subscribers, SAFE is authorized to access and manipulate such information
as a condition of use of, or access to ERIC.
Information and/or data that are generated by SAFE and ERIC collectively
shall be used only for the purposes of providing services as may
be contracted. Any reproduction of the information and/or data shall
only be for the internal operations of the Subscriber. The Subscriber
may not under any circumstances resell data for any purpose.
Access to Records
You have the right to inspect our records that contain personally
identifiable information about you and correct any errors in such
information. If you wish to inspect our records, please notify us
in writing and an appointment at our local business office will
be arranged promptly during our regular business hours.
Notification of Changes
The Company's privacy Statement and use of personally identifiable
information is subject to change at any time without notice. The
